Article 1. Purpose
The purpose of this Terms and Conditions of Use (hereinafter referred to as the “Terms and Conditions”) is to define the rights, responsibilities and liabilities in using online services provided at http://global.yes24.com/en.yes24.com/cn.yes24.com (hereinafter referred to as the “global.yes24.com”) by YES24.
Article 2. Definition
In this agreement, the following terms shall have the following meanings:
① “global.yes24.com” refers to a virtual business platform set up by YES24, in order to provide Users with goods (hereinafter referred to as the “Goods” or the “Goods, etc.”), where goods can be traded using computers and other information and communications facilities. It can also be used to refer to the company that operates the cybermall.
② “User” refers to Members and Non-Members that log into “global.yes24.com” and use the service provided by YES24 in accordance with this Terms and Conditions.
③ “Member” refers to those who have opened an account by providing personal information to YES24, and who are able to continuously receive YES24’s information and use services provided by YES24.
④ “Non-Member” refers to those who use services provided by YES24, without opening an account.
Article 3. Display, Explanation and Amendment of the Terms and Conditions of Use
① To provide visibility to users, YES24 shall display, on the main service page (front page) of global.yes24.com, the contents of this Terms and Conditions, name of company and representative, office address (including an address where customer complaints are handled), phone number, fax number, e-mail address, business license number, and the name of the personal information manager. Provided, that the contents of this Terms and Conditions can be displayed through a link page for Users to see.
② Prior to receiving the consent of Users on this Terms and Conditions, YES24 shall provide a separate link page or popup window explaining to Users important details of this Terms and Conditions, such as cancellation rights, liability for delivery of goods, and refund conditions, and receive the confirmation of Users.
③ YES24 may make amendments to this Terms and Conditions to the extent that it does not violate the Framework Act on Electronic Commerce.
④ Should YES24 make amendments to this Terms and Conditions, it shall specify the effective date of the amendment and the reasons for the amendment and notify this, along with the current Terms and Conditions, on the main page of YES24, starting from 7 days prior to the effective date until the day before the effective date.
Provided, if the Terms and Conditions are amended to the Users’ disadvantage, YES24 shall notify of such changes with at least a 30-day grace period. In such a case, YES24 shall provide a clear comparison of the Terms and Conditions before and after the change, in an easy-to-understand method.
Article 4. Provision of and Changes in Services
① YES24 shall perform the following duties:
1. Provide information regarding Goods and conclude purchasing contracts
2. Deliver Goods on concluded purchasing contracts
3. Other duties designated by YES24
② In the event that Goods are sold out or technical specifications are modified, YES24 may replace Goods that will be provided in future contracts. In such a case, YES24 shall specify the replacement of Goods and date of application and immediately notify this on the page where current Goods are displayed.
③ In the event that changes are made to the services that YES24 agreed to provide to the User due to reasons of Goods being sold out or modifications being made to technical specifications, YES24 shall notify the cause to the User.
④ Following the previous Clause, YES24 shall compensate for all damages caused. Provided, if YES24 proves that such event occurred without intent or negligence, this shall not apply.
Article 5. Suspension of Services
① YES24 may temporarily suspend the provision of its services as a result of the following reasons: maintenance, replacement and damage repair of computers and other information and communications facilities, and communications interruption.
② YES24 shall compensate Users on damages caused by a temporary suspension of services due to reasons stipulated in Clause 1. Provided, if YES24 proves that such event occurred without intent or negligence, this shall not apply.
Article 6. Opening an Account
① Users shall apply for an account by filling out their personal information on the registration form designated by YES24, and by expressing their consent to the Terms and Conditions.
② YES24 shall grant membership to Users who apply for an account following Clause 1, given that the following cases do not apply to the User:
1. In the event that the applicant has experience of losing membership for reasons stipulated under Article 7.3 of this Terms and Conditions (Provided that, exceptions shall be made to applicants who have acquired YES24’s approval to re-apply for an account, after three (3) years since they lost their membership in accordance with Article 7.3)
2. In the event that a false entry, omission, or error is found in the registration form
3. In the event that granting membership is deemed to pose considerable technical difficulties to YES24.
③ The account shall become effective at the time the Member receives YES24’s approval.
④ In the event that changes are made to the Member’s registration information following Article 15.1, Members shall immediately notify YES24 of such changes via e-mail or other methods.
Article 7. Closing your Account and Loss of Eligibility
① Members may request YES24 to close their account at any time, and YES24 shall immediately process this request.
② YES24 may limit or suspend membership for any of the following reasons:
1. In the event that the Member registered false information when applying for an account
2. In the event that the Member does not make payments for Goods purchased using YES24 and for other liabilities related to using YES24 on the appointed date.
3. In the event that the Member interferes with others’ use of YES24 or threatens the order of e-commerce, such as through the illegal use of others’ personal information
4. In the event that the Member attempts to use YES24 to raise political discussions or act in ways that go against public order and good morals or in ways that are prohibited by the law or by this Terms and Conditions
③ Should the same actions be repeated twice (2) or more or not corrected within thirty (30) days after YES24 limits or suspends membership, Member shall forfeit their membership.
④ In the event that Member forfeits their membership, the Member’s account will be cancelled. In this case, YES24 shall notify this to the Member and give at least thirty (30) days before the cancellation of the account for the Member to have a chance to explain the cause.
Article 8. Notification to Members
① In the event that YES24 sends notifications to Members, it may be agreed in advance with YES24 to be sent to the e-mail address designated by the Member.
② In the event that notifications are made to unspecified Members, YES24 may replace individual notifications by displaying such notification on the notice board of the YES24 website for one (1) week or more. Provided, individual notifications shall be made on matters that may have a significant impact on the Member’s transactions.
Article 9. Purchase order
YES24 Users shall make purchase orders on global.yes24.com in the following, or in a similar, manner. YES24 shall provide the following information in an easy-to-understand manner to aid YES24 Users when making purchase orders. Provided, items 2 or 4 may not apply for Members.
1. Search and select Goods, etc.
2. Insert name of recipient, address, phone number, and e-mail address (or mobile phone number)
3. Confirm cost-bearing matters such as the contents of this Terms and Conditions, services that have limited cancellation rights, delivery fees, installation fees, and others
4. Agree to this Terms and Conditions and confirm or refuse the above item 3 (i.e. mouse click)
5. Make orders and confirm the purchase of Goods, etc., or agree to YES24’s confirmation
6. Select payment and delivery method
7. Check the confirmation e-mail for the registered order sent by YES24 after the completion of purchase order
Article 10. Conclusion of Contract
① YES24 may not accept a purchase order in Article 9 if it falls under any of the following items.
Provided, in the event of concluding a contract with a minor, YES24 shall notify that the contract can be cancelled by the minor themselves or a legal representative, should there be a failure to receive the consent of a legal representative.
1. In the event a false entry, omission, or error is found in the purchase order
2. In the event a minor purchases Goods that are prohibited by the Youth Protection Law
3. In the event that approving purchase order is deemed to cause considerable technical difficulties to YES24
② The contract is deemed to be concluded at the point in time that the User receives the approval of YES24 via a notice of receipt, in the form stipulated under Article 12.1.
③ YES24’s approval shall include information regarding confirmation of the User’s purchase order, sales availability, and the correction or cancellation of purchase order.
Article 11. Payment Method
Any of the following payment methods may be used to make payments for Goods purchased at YES24. Provided, YES24 shall not collect additional fees in regards to the payment method utilized by YES24 Users.
1. Aliypay
2. PayPal
3. Overseas credit card
4. Points offered by YES24, such as mileage points
5. Gift vouchers or coupons approved by YES24 or that have a contract agreement with YES24
Article 12. Notice of Receipt & Correction and Cancellation of Purchase Oder
① YES24 shall send a notice of receipt to Users upon receiving the User’s purchase order.
② In the event of a discord between the User’s intent and the received notice, the User may immediately request for a correction or cancellation of the purchase order upon receiving the notice. YES24 shall process the request accordingly without any delay, in the event that the User makes this request prior to the delivery. Provided, if the payment has already been made, the guidelines detailed in Article 15 (Cancellation of Purchase) shall apply.
Article 13. Supply of Goods
① Unless the date of delivery has been otherwise agreed with the User, YES24 shall take necessary measures such as customizing production and packaging, so that Goods, etc. can be delivered within seven (7) days from the date that the User made the purchase. Provided, if YES24 has already received payment for the Goods, etc. in whole or in part, YES24 shall make the delivery within two (2) business days from the receipt of the payment in whole or in part. In such a case, YES24 shall take appropriate measures to inform the User on the delivery procedure and delivery status of the Goods, etc.
② YES24 shall specify the delivery method for the Goods purchased by the User, the payer of delivery costs for each delivery method, and the delivery time for each delivery method. In the event that YES24 exceeds the agreed period of delivery, it shall compensate the User for any damages caused. Provided, if YES24 proves that there was no willful negligence involved, this shall not apply.
Article 14. Refund
In the event that the Goods, etc. ordered by the User cannot be delivered or provided due to reasons such as out of stock, YES24 shall notify the cause to the User without any delay, and if payments for the Goods, etc. have already been made in advance, YES24 shall refund the payment within seven (7) business days from the date of receipt or take necessary measures for the refund.
Article 15. Cancellation of Purchase
① Users, who have concluded a purchasing contract with YES24, may cancel their purchase within seven (7) days from receiving the notice of receipt, given that the Goods, etc. have not yet been shipped. The purchase cannot be canceled during delivery.
②Users may not return or exchange the delivered Goods, etc., in any of the following events:
1. In the event that the Goods, etc. has been lost or damaged at the fault of the User (provided, cancellation of purchase may be acceptable if the packaging was damaged in the process of checking the Goods, etc.)
2. In the event that the value of the Goods, etc. has significantly dropped due to partial consumption or use by the User
3. In the event that the value of the Goods, etc. has significantly dropped, to the extent that it is not suitable for resale due to the lapse of time
4. In the event that the original packaging has been damaged, for Goods, etc. that are replaceable by other Goods that show the same qualities
③ In case of items 2 or 4 of Clause 2, Users shall not be limited in canceling their purchase, if YES24 failed to clearly specify, where it is easily visible to the consumers, the fact that there are limits to the cancellation of purchase or failed to takes measures such as providing a trial product.
④ Regardless of Clauses 1 and 2, in the event that the delivered Goods are different from the advertisement or have been provided differently from the contract, Users may cancel purchase within three (3) months from the date they received the Goods, etc., or within thirty (30) days from being aware of this or from the date they could have possible become aware of this.
Article 16. Effect of Purchase Cancellation
① In the event that Users return the Goods, etc., YES24 shall refund the payment of Goods, etc. within seven (7) business days. Should there be a delay in the refund to the User, YES24 shall pay the User overdue interests, calculated by multiplying the number of delayed days with the overdue interest rate designated by the Korea Fair Trade Commission.
② In refunding the above-mentioned payment, in the event that the User used payment methods such as a credit card or digital currency to pay for the Goods, etc., YES24 shall immediately request the suspension or cancellation of the payment to the business that provided the payment method,
③ In the event of purchase cancellation, the User shall bear the cost of returning the delivered Goods, etc. YES24 shall not claim damages or penalties to the User on grounds of purchase cancellation. Provided, YES24 shall bear the cost of returning the Goods, etc., in the event that a purchase is canceled because the delivered Goods, etc. is different from the advertisement or have been provided differently from the contract.
④ If the User bore the cost of delivery when receiving the Goods, etc., YES24 shall clearly specify who will bear the cost of delivery upon the cancellation of purchase, in an easy-to-understand method.
Article 17. Privacy Protection
② YES24 shall, in all cases, receive the consent of Users when collecting personal information that can be used to identify the User.
③ Personal information obtained shall not be used outside of their intended purposes or be disclosed to a third-party, without the consent of the User, and YES24 shall be liable for this. Provided, exceptions shall be made in the following cases:
1. In the event that a minimum amount of User information (Name, Address, Phone Number), needed for delivery, is disclosed to the shipping company
2. In the event that personal information is provided in a form that cannot be used to identify specific individuals, so that it can be used for statistics, academic researches or market studies
3. In the event that personal information is needed to calculate payments arising from the transaction of Goods, etc.
4. In the event that personal information is needed for identification, as a means to prevent the illegal use of others’ information
5. In the event that there is an inevitable cause for the need of personal information in accordance with the law or the terms of the law
④ Should YES24 need to receive the consent of the User following Clauses 2 and 3, it shall specify or notify in advance the identity of the personal information manager (affiliation, name and phone number, other contacts), the purpose of information collection and use, information about the third-party recipient (recipient, purpose of disclosure and information to be disclosed), and other provisions stipulated in the Act on the Promotion of Information and Communications Network Utilization. The User may cancel their consent at any time.
⑤ The User may, at any time, request to view or correct their personal information possessed by YES24, and YES24 shall be responsible for taking necessary measures without any delay. In the event that the User requests for the correction of an error, YES24 shall not use the personal information in question, until the error has been corrected.
⑥ In order to protect the privacy of Users, details on the provision and handling of personal information shall be notified, in detail, on the “Personal Data Processing Policy,” which shall be approved by the User separately from this Terms and Conditions.
Article 18. Responsibilities of YES24
① YES24 shall not take any actions that go against public order and good morals or that are prohibited in this Terms and Conditions or by law, and it shall strive to provide Goods and Services in a consistent and stable manner, in accordance with this Terms and Conditions.
② YES24 shall be equipped with a security system to protect the personal information (including credit information) of Users, so that it can provide a safe environment for Users to use online services.
③ In order to improve the quality of services and increase benefits for Users, YES24 may notify the following via SMS, e-mail, or TM through its customer service center:
Provided that, unwanted for-profit advertisements shall not be sent to the User.
Article 19. Responsibilities regarding Member ID & Password
① Excluding the case of Article 17, the User shall be responsible for managing their ID and password.
② Users shall not allow any third-party to use their ID and password.
③ In the event that the User becomes aware that their ID and password has been stolen or is being used by a third-party, the User shall notify YES24 and follow the instructions of YES24.
Article 20. Responsibilities of User
The User shall avoid the following actions:
1. Registering false information at the time of application or revision of information
2. Illegally using others’ personal information
3. Altering information displayed at YES24
4. Transmitting or displaying information (computer programs, etc.) other than the information designated by YES24
5. Infringing the copyright or intellectual property rights of YES24 or a third-party
6. Damage the reputation of or interfering with the work of YES24 or a third-party
7. Posting or disclosing political discussions and indecent or violent messages, video, voice messages and other information that goes against public order and good morals
Article 21. Jurisdiction and Governing Law
1. E-commerce related lawsuits arising between YES24 and the User shall be forwarded to the court having jurisdiction, in accordance with the Civil Procedure Code.
2. E-commerce related lawsuits arising between YES24 and the User shall be governed by the law of the Republic of Korea.

Third, when you use additional services or customized services or apply for events, we collect information such as shown below exclusively from users of the given services in so far as we obtain your consent for additional collection of personal information.

4. Protection of Non-members' Personal Information
(1) In case of non-member orders, "YES24" only requests personal information that is required for shipping, payment, order detail inquiry, purchase confirmation and confirmation of legal names. In this case, the information is only used for the purposes related to payment and item shipping.

(1) "YES24" does not use the personal information of its users, other than the information disclosed through the Internet services screens, for purposes other than required to provide its Internet services, nor it provides personal information to third parties without its users' consent, except for the following cases.

(2) "YES24" may provide or share personal information with its partners to provide better services to its users. When providing or sharing personal information, we undergo the process of individually obtaining agreement from our users in advance by notifying the users who the partners are, what information is shared or provided, why such information must be provided or shared, how long such information is kept and how it is protected. In the case that users do not agree to the provision or sharing of personal information, we do not provide or share the information to or with partners. Also, users may withdraw the agreement at any times, even if they agree to provision of their personal information.

(3) When using services of "YES24" without registering for the membership, payer information and recipient information that you provide are not used for purposes other than those related to payment and shipment of items.
(4) When providing personal information to family sites such as fashion malls, we obtain agreement in advance on the beneficiary of personal information, purpose of collection and use of personal information, personal information provided and period of retention and use of personal information. Additionally, in case you want to withdraw the agreement on provision of personal information, you may do so for yourself by changing your personal information on the website. However, your use of services may be restricted when you withdraw your agreement.

6. Viewing and Revision of Personal Information and Withdrawal of Consent (Membership Withdrawal) to Collection of Personal Information
(1) If a user views/changes his/her personal information at "My Page > Personal Information > Manage Account Information" after logging on to YES24 or contacts the chief privacy officer via letter, phone call or email regarding his/her personal information, we will take immediate measures. However, a user cannot change his/her user ID. Changing his/her name is possible after personal authentication only when he/she was rechristened.
(2) A user may withdraw his/her agreement on collection and use of the personal information at any times. A user can withdraw his/her agreement for himself or herself by logging on to the "YES24" website and navigating to "My Page > Personal Information > Withdraw Membership." Or a user may send a request to the chief privacy officer of "YES24" via email or letter and the chief privacy officer will take immediate actions according to the request and, for example, will destroy his/her personal information.
7. Periods of Retention and Use of Personal Information
In case that "YES24" collects and retains personal information of its users, the retention period starts when the user registers for the membership and ends when the membership terminates, including when the user requests for membership withdrawal or when "YES24" terminates the membership of the user. Also, in the event of membership withdrawal, "YES24" will destroy the collected personal information so that it cannot be viewed or used. If the personal information was provided to third parties, we will instruct the third parties to destroy the personal information. Additionally, we will destroy the personal information when the purposes of personal information collection or receipt are fulfilled.
(1) Payment information is retained until the payment is completed or until the extinctive prescription of the debt is completed.

12. Personal Information Protection for Children
(1) For children who are 13 years old or younger to register for "YES24", they must obtain their legal guardian's agreement.
Thus the registration for "YES24" membership is completed only after personal authentication of a legal guardian.
Personal information provided by the legal guardian is only used for confirming their agreement.
(2) "YES24" shall immediately take necessary measures if a legal guardian requests viewing, revision or deletion of the information collected from their children who are 13 years old or younger.

14. Consignment of Personal Information Handling

15. Protection of Personal Location Information
(1) "YES24" may collect and use location information to provide location-based services.
(2) Collection, use, and provision of location-based information are not performed for purposes other than those listed in (1). Information that does not have the grounds for its retention is destroyed after the purposes of its use are fulfilled.

16. Personal Information of Mobile Applications
(1) "YES24" may generate, collect, use, and store the following information to provide the mobile application services.

"YES24" does not take responsibilities for problems stemming from personal mistakes committed by users or fundamental dangers of the Internet.
② Users' personal information is protected by passwords and encryption by default, and important data are protected by additional measures such as encryption of files and transmitted data.
③ "YES24" has taken measures against computer viruses by using vaccine programs, and the vaccine programs are updated regularly. The up-to-date vaccine programs prevent a virus from infecting the system by providing the cure for the virus and preventing infringement of personal information.
④ "YES24" transmits personal information on a network using safe encryption algorithms.
⑤ To prevent personal information from being leaked or damaged by hacking or viruses, "YES24" monitors and manages the network 24/7 by adopting the systems that detect or block external infiltrations. The infiltration detection system and infiltration blocking system have redundant configurations to prepare for any emergencies.
(2) "YES24" is aware of the importance of protecting personal information, limits the number of employees who handle personal information to a minimum, and does its utmost to protect personal information by regularly holding training sessions for employees who handle personal information under the supervision of the chief privacy officer. In addition, we regularly inspect the employees' compliance with this policy, removing problems and taking necessary measures if any violations of the policy are observed.

12. Personal Information Protection for Children
(1) For children who are 13 years old or younger to register for "YES24", they must obtain their legal guardian's agreement.
Thus the registration for "YES24" membership is completed only after personal authentication of a legal guardian.
Personal information provided by the legal guardian is only used for confirming their agreement.
(2) "YES24" shall immediately take necessary measures if a legal guardian requests viewing, revision or deletion of the information collected from their children who are 13 years old or younger.
(3) If a legal guardian wants to view, revise or delete personal information of their children, they may contact the Personal Information Complaint Team. The necessary measures will be taken immediately after confirming your status as a legal guardian.

14. Consignment of Personal Information Handling
"YES24" consigns personal information handling to external agencies to a minimum extent to provide stable and convenient services. The period of retention and use of personal information ends when the membership is withdrawn or the consignment contract is terminated. 15. Protection of Personal Location Information
(1) "YES24" may collect and use location information to provide location-based services.
(2) Collection, use, and provision of location-based information are not performed for purposes other than those listed in (1). Information that does not have the grounds for its retention is destroyed after the purposes of its use are fulfilled.
(3) "YES24"'s responsibilities and users' rights regarding the protection of location-based personal information conform to the ’Act on the Protection, Use, Etc. of Location Information' and related laws.
16. Personal Information of Mobile Applications
(1) "YES24" may generate, collect, use, and store the following information to provide the mobile application services.
(2) When users use the services through a mobile app for smartphones, etc., "YES24" shall obtain their agreement on the collection and use of their personal information and carry out such actions within the obtained agreement.
- Login data for the mobile device
- Location-based information
- Mobile device ID, model, OS, and type of browser
- Photos, media, files, etc.
- Other information of which "YES24" obtained users' agreement on collection.
Users may access and change their user settings at any time, and can delete their usage history in the Settings menu under Device Options. However, users' member accounts are not deleted even if they delete the app in their devices. So, if they don't want to use the services anymore, they should withdraw their membership in the "YES24" website.
17. Obligation of Notification
The current privacy policy was established on Nov. 29, 2002. When there are additions, deletions, or modifications to the policy due to changes in the policy of "YES24" or the government regulations, such changes shall be immediately notified on the "YES24" website. The policy shall become effective on the day of notification.
